State Rehabilitation Council

There is hereby established, in the Government of the District of Columbia, a District of Columbia State Rehabilitation Council (hereinafter referred to as the "Council").

The Council, with the Administrator of the Rehabilitation Services Administration of the District of Columbia Department of Human Services, jointly develops, agrees to, and reviews goals and priorities on the provision of vocational rehabilitation services to persons with disabilities in the District of Columbia.

The Council shall:

a. Review, analyze, and advise the Administrator regarding the performance of the responsibilities of the state agency relating to eligibility (including order of selection);

b. Review, analyze and advise the Administrator on the extent, scope and effectiveness of services provided;

c. Advise the Administrator on the functions performed by the Rehabilitation Services Administration that affect or that potentially affect the ability of individuals with disabilities in achieving employment outcomes;

d. Advise the Administrator regarding activities to be carried out, and assist in the preparation of the State Plan and amendments to the plan, and required applications, reports, needs assessments and evaluations;

e. Coordinate with other councils within the District of Columbia including, but not limited to, the Statewide Independent Living Council, Individuals with Disabilities Education Act Advisory Panel, State Mental Health Planning Council, State Developmental Disabilities Council and State Workforce Investment Council;

f. Facilitate working relationships between the Rehabilitation Services Administration, the Statewide Independent Living Council, and the Center for Independent Living;

g. Develop, review and agree to the Administration's goals and priorities in partnership with the Administrator;

h. To the extent feasible, conduct a review and analysis of the effectiveness of, and consumer satisfaction with, vocational rehabilitation services in the District of Columbia;

i. Prepare and submit an annual report to the Mayor and the Commissioner, U.S. Department of Education, Rehabilitation Services Administration on the status of vocational rehabilitation programs in the District of Columbia;

j. Hold hearings and public forums as the Council may determine to be necessary to carry out the duties of the Council; and

k. Perform other related duties consistent with the purpose of Title I as the Council deems appropriate.

The Council will be composed of at least 21 members, not including ex-officio members. The Council will include individuals with disabilities; parents, family members and guardians of individuals with disabilities; and at least one representative from each of the following:

1. Statewide Independent Living Council;

2. Client assistance program;

3. Parent training and information center;

4. Community rehabilitation program service providers;

5. At least four representatives of business industry and labor;

6. Representatives of disability advocacy groups representing a cross section of individuals with physical, cognitive, sensory, and mental disabilities and representatives of individuals with disabilities who have difficulty representing themselves; and

7. Current or former applicants for or recipients of vocational rehabilitation services;

8. At least one representative of the State Workforce Investment Council.

Ex-officio members shall include the Administrator of the Vocational Rehabilitation Agency or a designee and at least one qualified vocational rehabilitation counselor.

Members of the Council shall be appointed to 3-years terms, except that of the first members appointed under this Order, one-third shall be appointed for 3-years from the date a majority of the first members are installed, one-third shall be appointed for 2-years from the date a majority of the first members are installed and one-third shall be appointed for I-year from the date a majority of the first members are installed. A member who is appointed to fill a vacancy in an un-expired term, shall serve for the remainder of that term.

The vacancy shall not affect the power of the remaining members to execute the duties of the Council. No member of the Council may serve more than two consecutive full terms.
